FIRST, A PROCLAMATION

 

It's wonderful that a levee will of course benefit the people of Valley Park.  I proclaim however, that the US ARMY CORPS OF ENGINEERS & CITY OF VALLEY PARK, knowing that landowners lack the time, money, knowledge, courage & stamina to oppose them, ARE USING THIS FEDERAL LEVEE PROJECT TO CONFISCATE & IMPROVE LANDS NOT TRULY REQUIRED FOR IT OR ITS INFRASTRUCTURE.  Instead & specifically, # 6, 7, 8, 9 & probably 10 Arnold Dr HAVE BEEN CONFISCATED & IMPROVED FOR FUTURE MUNICIPAL REDEVELOPMENT, ACCREDITATION & PROFITS.  They have filled Arnold's Landing, elevating if from the floodplain as much as possible while referring to it simply as an extra wide levee & a disposal area. 

 

And yes, the area looks better & wouldn't yours too if everyone's old homes & businesses were confiscated from them, torn down & replaced with something new for the public's health, safety, welfare, morals, use, necessity, benefit &/or whatever else can be exploited to further enrich certain individuals already rich with authority &/or money!

Welcome to my nightmare!  This page is also used to supplement the minutes pages & in fact, it opened relevant to the 8/19/02 Levee mtg.  Plans had been to compose it to date, post it & then simply add current info.  But since events, priorities & time constraints rendered that impossible, info is being added here & there when possible & as deemed necessary.  Info is from extensive notes at the time, memory & documents obtained.   

 

The same Initials & Abbrevs used thruout MOPR.ORG will be used here.  Below the big bold subject date is its original posted date.  Unlike MOPR mtg mins, a colon & text after names & initials below, represents what I felt noteworthy that was basically said (ending with this symbol <).  This format is preferred to 'he said & I said...'.  Direct quotes will have quotation marks.  Please understand that until this page is up-to-date, info may be rearranged a bit here & there to tie up loose ends.

After working, scrimping & saving minimum-wage earnings like forever, I purchased my first & only rental property, #8 Arnold Dr at Arnold's Landing/Grove (AL) in the infamous City of Valley Park, MO, 63088.

 

Arnold's Landing is a private cul-de-sac of almost 10 acres, bordered on the north by RR tracks about 15 to 20-foot high;  on the east, by Hwy 141 with one lane heading south & one north;  on the south, by the Meramec River;  & on the west, by Fishpot Creek which tunnels under its RR bridge.  Arnold's Landing is uniquely private, yet within one minute of I-44 & about 5 minutes of I-44/270.  Click on Photos - Arnold's Landing/Grove.

 

#8 Arnold Dr was listed for $30,500, but I purchased it for $23,000 since unfortunately, the previous owner had been caught up in a bankruptcy due to his partner's problems.  #8 was zoned E, for shops, office & retail.  The Gundaker spec sheet shows:  6 rooms, 3 bed, 1 bath;  age 27;  24 x 48 well-built garage;  full basemt;  public sewer & water;  level 39x120x194x226 lot;  mls #701421. 

 

Shortly after closing, my best friend, Ed Harrawood, & I improved my property;  mainly, by widening & extending the driveway from the detached garage to the beautifully-stoned front porch of the house.  The house and garage were pink & I LOVED IT !!!   Click on Photos - #8 Arnold Dr.

Per Mayor Harrington's 6/6/95 Letter, due to the COE's re-alignment of the levee at AL, the city will need to buy about 4 homes in the eastern-most part of AL.  I believe that means #1 & 4 Arnold Dr, which are next door to each other on the south side of Arnold Dr, owned by Ed Harrawood;  #6 on the north side, owned by Richard McGhee (who goes by Mike);  & #7 on the north, owned by Ed Harrawood.  If a 5th house would be bought, it would be my #8 which is next to #7.

Larry Hedrick & Sebastian Rucci came to my home today & I signed a $100,000 Sale Contract with Mr. Rucci of Meramec Development Co for #8 Arnold Dr.  He had signed contracts with most AL landowners, possibly all homeowners, & was going to raise AL out of the 500-yr floodplain with elevating fill & build a strip mall;   negating the need for a levee at Arnold's Landing!

Ed Harrawood & I met Condemnation Atty Bob Denlow at AL where Bob gave me his impressive brochure.  MM:  I have rental agreements on the house & garage, totaling $950/mo rent + utilities, & I want to keep my property.  Ed: Previously, the levee was supposed to have been built only on the south side of Arnold Dr, except at the west end, heading north along Fishpot Creek to the tracks;  that was the best design for the city & the landowners.  EVERYBODY would've benefited if they'dve offered me & the Browns decent prices for our properties!

 

Bob:  Since you've rcv'd a buy-out offer, there's little to no likelihood of that & having the levee around it.  Anyway, you'd be better off without rental property & all those hassels;  it's better putting money in stocks.  MM:  I still have my 4/98 $100,000 Sale Contract from Sebastian Rucci of Meramec Dev Co, tho it didn't close.  Bob:  Great!  <  Ed signed Bob's Atty - Client Agreement, but I said I'd like to think about the one he prepared for me.  Driving around past the g/p, Bob & Ed talked about TIF, the floodway, floodplain & that they thought the city was going to come out great.  Then Bob left.

 

Ed said that Bob's contract was basically the same as most Condemnation Attys'.  The CONDEMNED PERSON MUST PAY 1/3 of any amt recovered by way of lawsuit, settlement or other disposition, over the original (or last) written offer;  PLUS, expenses such as, appraisers, surveyors, expert witnesses, copy & mailing costs, court fees, travel, etc.

Called & asked EM for a copy of the Uniform Relocation Assistance & Real Property Acquisition Policies Act of 1970, P.L. 91-646.  EM:  That's for owner-occupied properties.  MM:  Is there one for rental properties?  EM:  Not for landlords;  it's for tenants' relocation assistance.  Bob Denlow thought he'd represent you.  Since I haven't heard from you, I've prepared a petition in Condemnation, but haven't filed it yet. 

 

It asks the court to appoint 3 disinterested cmsnrs to appraise #8, then they file their reports & the judge signs off.  When the report is filed in court, notice is sent & each party has 10 days to file Exceptions.  Either way, I pay the money ordered by the cmsnrs into court & I have the right to take possession, unless you object within 5 days.  If you show good cause, the court can grant an extension on me taking your property.  Even if you or I file Exceptions, I still get title to your property, but we fight about the only issue, fair market value.  You're entitled to a jury trial which usually takes 1.5 to 2.5 yrs & you get no rental income during that time;  but that would be damages you could claim at the trial.

 

MM:  What about my tenants?  EM:  Once I take over your property, I have to give them 90 days to move out.  MM:  Will you write me a letter about all this?  EM: I don't have anything like that.  MM:  You don't have written procedures?  EM:  I go by the statutes.  You can go by VP Library & look at statutes, but St Louis County Library doesn't have statutes. 

 

MM:  How soon can you take over my property?  EM:  60 days.  MM:  Someone said I should get a state certified appraiser.  Is that right?  EM:  The appraiser does not have to be state certified.  It all depends on what the cmsnrs decide.  MM:  Your $30,000 offer must be a joke!  EM:  Didn't you pay $9000 for #8?  MM:  No, $23,000.  EM:  How much do you think your property is worth?  MM:  I'll have to do some figuring on that;  might hire an atty;  just don't know what to do yet, but I'll let uno tomorrow.

Called & talked with EM.  MM: Sorry, no appraisal, $ figure or atty yet.  Did you base your $30,000 offer on the $9000 you thought I paid for #8?  EM:  No, purchase price doesn't matter at all.  Our appraisal is based on an outside-only appraisal with a floor plan from an old appraisal & the condition of the property in '94.  MM:  That was a flood time.  EM:  It was also based on comparative property sales, #9 Arnold Dr is in the mid 30's.  I think #10 went for $48 to 49,000,  #11 was also in that range.  Nothing has gone for over $50,000 & that was about 8/00.

Called & talked with EM.  MM:  I have not hired an atty.  EM:  I should think you'd want a lawyer.  MM: I don't want to, but guess I may have to.  I have a $100,000 Sale Contract on #8 from 2.5 yrs ago with Sebastian Rucci of Meramec Development Co, tho he didn't close.  I also have rental agreements on the house & garage that total $950/month, plus utilities.  I'm not estimating value, but only stating that I will settle for $125,000.  EM: My limit is to go up 10%, to $40,000.  I should think you'd want a lawyer & Bob Denlow is familiar with the issues;  but even with a lawyer, you're stuck with the 3 cmsnrs & I have no ties with them. 

Next step is I'll file the Petition to Condemn;  you'll get served & then the court hearing decides if the city has the right to condemn.  I know Denlow won't contest it.  You're welcome to come to the hearing;  I'll give you notice if you want to come.  Preliminary approval is the 1st hearing, just the judge & me.  He okays the petition, sets the hearing on if the city has the right to condemn & cmsnrs should be appointed.  MM:  When is the hearing?  EM:  At least 30, no, more like 90 days.  MM: The hearing to find out if you can condemn?  EM: 60 days - you get 30 days to respond to the petition if you want to;  you don't have to, but you'll be notified in time to act.

LEV & BOA mtgs today.  I was shocked & relieved when EM commented in today's levee mtg, that only PART of my property is needed for the levee project!  (1st "taking" change)  After the mtg adjourned, I skeptically stepped up to the table, JZ, EM & CLM, simply said tku & left.  Outside, when I approached RC speaking with Tom Horgan, of Cgsm Talent's office, RC told me that Mr. Horgan was the man to thank (for being able to keep part of my prop), so I did.

At 9:50 am, RC called me & said that last Fri afternoon, some people were told of a 10 am mtg set for today at the VP School;  Atty Tom Cunningham, rep'g some developer, had contacted EM;  it was re AL, my property & maybe Tory's of Environmental Landscaping;  BL had told him to inform me.  RC assured me that I could barge in & if anyone asked how I knew about the mtg, I could just say he told me!  He made me laugh when he said to be sure to put 2 "L's" in his name.

 

I flew out the door & Officer Ebert of the Manchester Police gave me tickets for no seat belt & for doing 60 in a 35 at 141 & Carmen.  I frantically explained & begged him to either please hurry with his paperwork or call an ambulance for a lady suffering a major anxiety attack! 

 

Click on 8/27/01 VP/QT mtg mins.  Being not only handsomely hot, after the mtg, Tory commented to me that Quik Trip doesn't care about improving VP's image & all that;  they sell adult magazines & only care about the bottom line.

Stressed-out today, I met Diane Favazza, Demba's Associate Appraiser, at #8 Arnold Dr & showed her like every inch of my #8 rental property for her 2-part appraisal;  the property as a whole before the taking;  & then the part to be taken.  She knew that Demba had done their 1st appraisal in the summer of '00, which evidently led to EM's 7/11/00 so-called fair market value of only $30,123.

 

MM:  These past 1-1/2 yrs have been lousy with this condemnation hanging over my head.  I've been working long & hard, fixing the place up.  I've had good tenants;  one dry-walled the whole garage, etc;  & of course I've had lousy tenants...  EM said the levee & access road are to be 20' in front of my garage... <  At one point somewhere, I was near tears & apologized for being so stressed out.  Diane seemed to truly admire the new $1250 carpet & pad (& installation);  & appreciate all my hard work & the landscaping I'd done with the huge rock borders, & weed-preventive lining under all the mulch & B gravel. 

 

DF:  I just started appraising in June;  had been in retail, but took a few yrs off.  This house showed up somewhere as being only a 1 bedrm.  MM:  You just saw, it's obviously 2 big bedrms, tho at one time it was 3.  You must mean before the other half of the house was added on & the garage was built.  I have the whole prop advertised in the paper now for $1150/mo, plus utilities.  I have a 4/98 Sale Contract from Sebastian Rucci for $100,000, tho he didn't close on it.   DF:  You can't count on that!  MM:  Darn good indicator!  & that was before the new Marshall Rd & 141 intersection, great access, & before I redid the entire property! <  I should've added that it was also before the expansion of Hwy 141.

Approaching VP City Hall for the Levee Cmsn mtg today, I realized the humidity & worried about my dog, Amber, being in the van, even tho I had water in her dish, the windows would be down & I'd get her out at times during the mtg.  When I arrived, Elliott "You Paid For It" Davis, of Channel 2 News & his cameraman were interviewing DM on the front porch.  In the hallway, several people strongly urged me to talk to Elliott on-camera;  someone had said, "Now's your chance!"  I explained that I'd be much, much too nervous!

 

Then DA brought CLM out of the chamber room & introduced him to Elliott who was standing next to Ed Harrawood & I.  CLM said he used to be the Dist Eng for the St. Louis COE & he started talking about federal funding.  Elliott interrupted & asked how much he gets paid as a levee consultant;  indignantly, CLM answered $1500 per month.  When Elliott said he wanted to talk to the city atty, CLM said he wasn't here yet.  I turned & quietly commented to Ed that I knew it was $1500.  Suddenly, CLM, walking off to the restroom, shouted to Elliott that he was going to find out & call Elliott's supervisor.  Elliott shouted down the hall to CLM that he'd give him the name & # to call, but CLM went into the restroom. 

 

Then Ed told Elliott that he had built the Sportsplex yrs ago & that I was opening a website about the levee; & to my great surprise, something about me stopping the taking of my property!  When Elliott asked me to cmt on-camera, I said, 'no, I'd be much too nervous;  maybe some other time'.  Since the mtg was starting, I went in, set up my recorder, but came back out & gave Elliott a copy of MOPR.ORG's Homepage that I had planned for its opening on 9/1/02;  & explained that no one really knows about MOPR.ORG yet.  (Ed later told me he'd already been telling people!)  Elliott finally convinced me to cmt on-camera. 

 

They led me back out onto the porch & Elliott dismissed my worry about possibly getting sued for libel, slander or whatever by speaking out.  Trembling head to toe, with the setting sun & that enormous camera both glaring directly into my eyes;  nearly dripping with a hot flash, plus the humidity;  Elliott asked me like what I thought about the taxpayers' money & how it's being spent on the levee;  & pointed the mic at me!  I almost told him I just wanted to take Amber & go home!

 

As I later recalled, I basically told him that the levee was about $14 Million a mile;  & there are too many organizations involved, like St L County Health, the Historic Register, MDNR, the EPA & whoever else;  & there's TOO much money going to engineers, surveyors, consultants, attys, appraisers, accountants, & whoever;  & they're low-balling people's property values;  I had a $100,000 sale contract for my property in 4/98 & in 7/00 EM offered me $30,000;  I thought it was a land grab, using Eminent Domain, & they want to tear down the buildings & improve the land with elevating eng'd fill from the g/f, & then sell it for big bucks profit to a developer.  Right after I started in abaut the two St L County Police Officers barging into my home, Elliott told the cameraman to turn it off.

 

Then DA & RC came out.  When DA told Elliott the levee was 3.5 miles, I politely interrupted, asking DA, wasn't it to be 3.1 or 3.2 miles.  DA then told Elliott that he didn't want bad publicity that could jeopardize the levee getting finished, & that DM ran a campaign to get rid of EM for personal & political reasons! <  We all went back in & after Elliott & his cameraman shot a few mins of the mtg, they left.  I took care of Amber & returned to the mtg.

After the IPR mtg today, I asked Craig Donis, the COE's Chief of Real Estate, Acquisition, how much he thought one would have to pay for a property in order to rent it out for $1000/mo, plus utilities.  He stated that he was not familiar with rental property & that's what appraisers are for.  I feel that Craig is actually a very good person;  I wish he knew my whole side of the story.  But as I watched his mouth still moving, all I heard was, 'yada, yada, yada;  I plead the 5th.'

I sent an email to Mr. Jim Mitas of Cgsm Akin's office; part of it was, " I have just been informed that I am not welcome to attend the levee related, weekly In-Progress Review meetings held every Tuesday now at the COE's office or VP City Hall.  Please let me know immediately if those in charge are legally allowed to deny my attendance & tape recordings of those meetings."   (see 6/4/03)

There's a Levee IPR mtg today, 1 pm, COE office.  But, prompted by city officials' cmts at the bd of ald mtgs on 5/5/03 (section 6) & 6/2/03 (very end), & JZ's cmt at the 5/20/03 Levee IPR mtg (top notes), at about 10:30 am, I respectfully called Mr. Jim Mitas of Cgsm Akin's office;  briefly explained the situation & that I was going to this mtg;  did not want to cause trouble there, but if they tell me I'm not allowed, they'll have to kick me out since I believe I have a right to attend & tape these mtgs.  I asked Mr. Mitas if both were my right.  He immediately checked, called & informed me that it was alright, instead of falling off my chair when he said, "enjoy", I thanked him sincerely.  I ASSumed that he had spoken with JZ & I thought JZ would be at the mtg;  I forgot that he was actually on vacation or whatever. 

 

Arriving at the mtg, I met Tom Hewlett, COE, Chief of Real Estate, Division, sitting alone in the CT-Bid Conference Room at about 1:55 pm.  When I told him that I owned property at AL, he said either that he knew of me, or had heard of me.  When I mentioned my difficulty with note-taking lately & that maybe it was carpal tunnel or just age, he said I needed a bigger piece of paper;  I laughed since I had wondered about that too. 

 

I asked him how much he thought one would have to pay for a property in order to rent it out for $1000/mo, plus utilities.  He looked baffled & basically said that he was.  When I rephrased it slightly, he said, "hold that thought" & left the room!  Greg Bertoglio entered & I complimented him on his wife, Kelly, in the COE's Office of Counsel, who had been helpful to me on the phone months ago with my FOIA requests.  When Greg & I discovered that a different group had this conf room reserved for an interview, he went out a different door, leaving me to possibly wander the hallways in search of the mtg!  But Tom Hewlett returned & then, leading me to his private office for the mtg, he said EM was there & asked didnít I know him.  I said, "sure, I know EM!" 

 

As mtg attendees were arriving, Tom jumped up to greet one man before he could enter, seemingly ready to participate;  but after a few words with Tom, the man left.  As I recall, Tom addressed him as Tim;  I wonder if it might've been Tim Nelson, the COE's Chief Appraiser.  I loved the seating arrangemt, being at the end of the small conference table, opposite Tom & EM;  handsome TW on my left, & then Carol;  to my right was presumably-nice Craig, & then Greg.  It was momentarily rather cozy! 

Just after the mtg, Tom gave me his card & said he knows my atty.  As I led Greg, TW & EM thru the partitions to the hallway, a VERY handsome, young guy walked by.  When Greg commented to me that he was in Real Estate, I was embarrassed about my uncontrollable gaulking.  (I'd probably do it again tho!)

I stopped by VP City Hall on the way home.  Roxanne referred my request for a copy of one page from the LCA to MW, who apparently searched;  but taking my phone #, said she'd check with DM to see if it was locked up in his office & she'd call me.

At 2:40 pm, I received Mr. Mitas' email response to mine of 5/31/03.  He kindly apologoized for the delay due to being out of town.  Re the weekly update mtgs, he wrote that he hoped the one I attended the other day was informative & most should be open to the public.  I was grateful for his response, but disappointed that he provided no answer to my specific query concerning tape recordings of those mtgs.

At about 6:45 pm, I emailed Mr. Mitas  to please read my 5/20/03 Levee/IPR mtg tscript in connection with the one of 6/3/03.

Today, while finally transcribing the rather clandestine mtg of VP City & School officials & Quik Trip reps, held at 10 am,  Mon, 8/27/01 at the VP High School, I received a phone call from Mr. Jim Mitas.  He had received my emails.  He said that he was a bit upset because he had only told me on 6/3, that the mtg was open to the public;  not that it was alright for me to record it;  & that I had asked on his call-back, if I could record it;  & that he had told me he didn't know & I'd need to ask.  I stood by my facts;  reminded him that he had even said, "go ahead;  do your thing;  enjoy".  I apologized profusely that we & our notes were disagreeing.

 

I asked Mr. Mitas if people weren't allowed to tape any mtg that's public.  He said he didn't know, but thought it was up to the chairperson or host.  He continued that it wasn't appropriate for me to use the Cgsm's name for my issue;  & after this, he'd tell me who the host was to call for myself.  I asked Mr. Mitas if he'd letter me about all this so I could respond & we could keep things straight; but he declined.  <  It truly saddens me that Mr. Mitas & I have had this misunderstanding.  I sincerely hope he has accepted my apologies;  & realizes that I only used Cgsm Akin's name simply to explain who he, Jim Mitas, was. 

 

As usual, I need an answer!  Are We The People legally allowed to tape any public mtg, regardless of the chairperson's  preferences?  It seems to me that City Atty EM would've told me right before or during the 6/3/03 Levee/IPR mtg if, in fact, I had no right to tape it.  What will the COE's reason be for cancelling the rest of the June, '03 Levee/IPR mtgs?

Reference MOPR's 5/3/04 VP BOA Mtg Partial Mins & Notes - Newspaper/Magazine Reporter Diane Plattner arrived at this 5/3/04 BOA mtg after I had addressed the BOA.  Mary Shapiro of the Press Journal arrived after the BOA had gone into Ex Ses.  I separately told both that I had addressed the BOA & gave Diane copies of the 3 related docs even tho I had given her a copy of EM's legal doc at the 4/19/04 BOA mtg & explained the situation to her.  I had left my # & msgs recently at the Post-Dispatch for her to call me, but my calls went unanswered.  When Mary said that she'd probably have to come back to city hall & listen to the city's tape of tonight's mtg, I told her that she could call me & I could fax her copies of the docs I had spoken about.  She said ok & agreed that she had my #. 

 

On 5/6/04 I emailed my 5/3/04 BOA address & their responses to Diane & Mary asking them to do all they could to inform the public about these issues.  As of 5/14/04 I have found nothing in the Press Journal or the West Newsmagazine (I haven't had time to check the Post-Dispatch)  regarding my cmts & haven't heard from either reporter.
